The Federal Court of Iraq has ruled that an article of the Political Prisoners Institution Law related to Hajj allocations is unconstitutional.
The decision concerns Article 3 of Law No. 10 of 2025, part of the Second Amendment to the Political Prisoners Agency Law, which required the Hajj and Umrah Board to allocate at least 2% of Iraq’s annual Hajj seats to political prisoners or their relatives in the event of their death.
The Iraqi Supreme Court, in a session attended by all member judges, reviewed the appeal challenging the article’s constitutionality.
The court concluded that the provision violates Articles 14 and 16 of the 2005 Iraqi Constitution, which guarantee equal rights and opportunities for all citizens.
